One of the most common misunderstandings about Extended School Year (ESY) is that it’s only for students who show regression over school breaks.

Regression and recoupment are factors, but they’re not the entire legal analysis.

IEP teams are supposed to consider the totality of the circumstances, including things like:

• regression and recoupment
• emerging or breakthrough skills
• rate of progress
• severity of disability
• whether a break in services would jeopardize meaningful educational benefit

The real legal question is:

Does the student need services beyond the normal school year to receive FAPE?
